There is no response about my cancelation process


I apply for canceling my DSL homecontract more than 1 month ago but I didnt get any response. I already move any I dont have any connect with my previous flat anymore. I doont know what should I do and I do not the process either. so far I just fill the document for cancelation you supposed to reach me as your mentioned their e-mail. Please contact me and let me know about the process. Because I will bloke the SEPA payment service soon.

I could take a look at your contract, the colleagues from our special department received your cancellation and could set the cancellation for October 2025. To check your apllication for earlier cancellation they would need a copy of the registration document for your new address.

When do the contract starts? Normally you get a 24 Month contract. That could only canceled after the 24 month.

it started October 2023 yes 24 months contract but I already moved and I cant use my internet anymore. There should be another cancellation process for the situation like that. So nobody reached me and told me that. if it is not possible why the website let me fill the cancellation papers and I am waiting for answer more than 1 month?

You have probably not updated your address details with o2 and they have tried to contact you at the address you entered in ‘Mein o2’. Have you set up a forwarding order with the post office so that letters sent to your old address can be forwarded to you?

If you want to cancel the contract before the minimum contract term expires, you must apply for this as “Art der Kündigung: außerordenlich” and enclose the necessary proof (deregistration certificate from the residents' registration office, proof that the service cannot be provided by o2 at your new address). 

Please note that there is no right to extraordinary cancellation if o2 can offer the service at your new address.  In this case, request a move (for a fee).

As you said I changed my address and I contact my landloard to get the documents if they exist in my mail box. But the problem is the apartment I move has its own internet. that is the reason I dont want to continue the contract anymore. (so technically the service can be provided by o2.) and the Burgeramt dont give abmeldung paper anymore. You need to register your new address only. So I have registraion document for my new address.

§60 Telekommunikationsgesetz (TKG) applies to cancellation in the event of a move. If the legal requirements for extraordinary cancellation described there are not met, your request will not be granted. What you want is irrelevant to the law.

yes ı read it. but the the law is about ‘If a consumer changes his/her place of residence and wishes to continue his/her contracts...’. so it is not my situation I think. It should be another way to cansel contract with fee. Because otherwise I will pay almost 1 year for service that I dont use.

You read the wrong paragraph. Paragraph 2 is decisive here. 

Wird die vertraglich geschuldete Leistung am neuen Wohnsitz nicht angeboten, kann der Verbraucher den Vertrag unter Einhaltung einer Kündigungsfrist von einem Monat kündigen. Die Kündigung kann mit Wirkung zum Zeitpunkt des Auszugs oder mit Wirkung zu einem späteren Zeitpunkt erklärt werden.

 

It is your decision whether you want to use the contractual service at the new address. Even if you decide not to use it, you must still fulfil the payment obligations arising from the contract you have concluded. Non-use does not release you from your contractual obligations.

Hello again, I was informed by e-mail that it is not possible to cancel my internet contract.

 

I already moved and I am living at my boyfriend’s house while looking for a new job. Would it be possible to have a Kulanz period and cancel my contract earlier, perhaps even with a small cancellation fee? There is already an inernet connection here by a different provider, and with a much faster connection speed. In addition, there is no extra plug available, so I would not be able to connect a second router with your service, even if I preferred it. I understand your position, but if we could make an exception to make my general situation a bit easier, I would greatly appreciate it.

Hello ​@yarenduygu,

in our article about moving to an address where there already is a DSL connection, the solution would be 3., with how to order a  move of your contract and connection given with the links under 1.

3 and a possible early cancellation will work if the contract at your new address is the same technology, that is DSL, not fiber or cable.

Hı Gerrıt, yes we have a DSL connection here. So what should my next steps be in order to cancel my contract? I have been trying to cancel it for two months now, so I would appreciate it if we resolve it quickly, so I don’t pay more money for a service that I am not using any more.

Hello ​@yarenduygu,

according to our article you can order a move from your current to your new address. Then the artickle says: If you requested the move and we are unable to order DSL in your new address we would terminate the contract with immediate effect and charge three basic fees in advance. This is a legal requirement.

@o2_Gerrit Your “article” ist outdated. The provisions of §60 TKG have changed. All o2 employees should be aware of this. You may want to read this again directly in the legal text:

Hello ​@yarenduygu, ​@blablup is correct, a cancellation is possible when, according to the legal text blablup linked:  If the contractually owed service is not offered at the new place of residence, the consumer may terminate the contract subject to a notice period of one month. The cancellation can be declared with effect from the time of moving out or with effect from a later date.

That means when a move of your technology and tariff to your new address is not possible with us. When you applied for early cancellation and the colleagues from our department concerned checked whether we can provide your tariff after a move and if positive, they cannot cancel early.
