Can you still cancel Contract in the O2 shop, once you signed already the contract?


Hallo Guys, 

I signed a Mobile Data Contract plan from O2 the unlimited Data On Demand last friday and I came back to shop today because im not happy with this unlimited plan because there is actually limit of data everyday and when you reached the Alloted Data per day you need to send a text to continue using it. This is a hassle to me. I want actually another plan from O2 the unlimited Smart but the guys in the shop recommended this unlimited on Demand plan. Question: The shop told me I cant cancel anymore the contract. Another Q, will i still be able to Recall it or Widerruf? I heard there is 14 days time to Widderuf is that correct?  thanks in Advance guys! :)

Then you can only clarify in the o2 shop.

I had it clarified there already but i am not satisfied by the answer. They told me it cant be cancelled anymore once you do it in shop. Maybe i can still do it somewhere thru Telephone hotline. 

No, but the o2 shop can clarify it via dealer support as a *goodwill* gesture. But he doesn't have to.

I did already spoke to them and told me once the contract is made in the shop it can be cancelled anymore. It is so weird that you cant cancel a contract when you are not happy and satisfied with service. I really thought there is a 14 days cancellation notice when you actually dont want to proceed with contract that you have signed in.

That's only for contracts via telephone or online. 

 

 

They told me that as well. So what is the exception to invalidate the contract? Would there be an exception on cancelling it?

as Bollermann wrote, the cancellation of a contract within the first 14 days is only possible for contracts made via our website or our hotline, not for contracts directly made in a shop. For contracts made in a shop a cancellation is only possible, when you also bought a device like a smartphone in connection with the contract.

Why is that, i cant be able to cancel the contract anymore? The thing with this contract is, it was not my planned contract, i supposed to get the Unli Smart contract but your colleague pursuade me of getting the Unlimited on Demand. Which i am not happy of because of the daily limit and the unlimited internet is not that actually unlimited because you need to do more steps to get more data and type weiter everytime you reached the daily limit. Your Colleage also said that I can change my contract back anytime but when I returned and told him that i am not happy with the Unli On Demand. He told me that I cannot anymore changed the contract back to a lower contract. I am really disappointed with his explanation. I should have chosen the 19,99$ UnliSmart instead of this Unli On Demand for 29,99€! I could have saved 10€ monthly.

the cancellation for contracts is only possible for the ones made via online portal or hotline, not for the ones made directly face to face in a shop.

Before you do so, you have to be shure if you rly want this contract to be signed. Its not O²s fault, that you dont know the german law. And if all people cancel a contract, while they dont want it anymore, no company can plan its income.

A contract is a contract. The only difference is when you order on the internet or by telephone, just as they told you already.

He actually told me that i can still change it anytime since thats not actually the contract i will be making that day. He just offered me that contract that day out of the blue. I wasnt sure about it and told me i can still change it if i change my mind. hahaha

There‘s a difference.

In fact a change without an extension is possible if for example the Mobile Unlimited Smart is available to change to. As I checked, as of now that change is not possible, in the future the Mobile Unlimited Smart might be available to change to but usually such a change is rather possible to bigger tariffs.

Thanks Gerrit for the reply. I actually messaged already the „Widerruf“ and they told me its not possible anymore to change unless there was a Handyphone bond with it together with the tariff contract. 

I just can‘t move on becaused i was actually persuade to get another contract instead of the one that i am supposed to get. He said „ its just 10€ more and you get more speed than the Unlimited Smart.“ I was also surprised that i cant change it anymore to other tariffs, becaused he said i can changed it anytime when actually you cannot anymore. And i found out as well i need to pay the connection price. :( Just sad because the contract I got online is without Connection Price 39,99€. I am an O2 customer! for 3 years now. Well i will move on from here. Thanks for everyone who responded and had helped in someways. Have a great time! 

@john2dmoon, it might be worth a try to contact us in 6 months from now in order for us to check for your contract whether it is then possible to change to a different tariff without extending the running time of your contract.
