Contract cancelation | Misleading salesman


I got a contract with o2 yesterday at a local store. And i want to cancel it cause.

  1. Salesman didn’t explain me the terms of contract clearly, i basically didn’t really know what i was signing for. We communicated in English but both aren’t reallty good at it, it seems. It’s only when i signed everything he mentioned that i basically would have two sim cards. I wasn’t offered to read the contract, he didn’t go over it in English i wasn’t informed on details of what plan i’m singning for. He did mention the price but also mispronounce it like two times which left me confused. And i didn’t ask for forth time cause it would be really rude at this point. Just straight up took the advantage of me not knowing German well enough to scam me into 24 month contract, and really expensive one too.
  2. The coverage is straight up terrible, i barely can use Internet. And i didnt have these issues with other SIM cards.
  3. I asked him about other plans multiple times as well, which he was evasive about and only went over two of them, the dual sim one and some other i don’t really remember.
  4. I did ask him about cancelation terms which he also was evasive about and didn’t really explain anything to me besides just saying that it’s not possible. (And i was asking what if i leave the country, which i still dont have the answer about.)

I would have never agreed to these terms or signed anything if terms were communicated clearly to me, i understand staff probably being paid percent of sales but isn’t it a little too far? Is there anything i can do? I don’t have stable income either and currently and it’s really expensive to me, i don’t really want to save on food to pay the thing i didn’t want and can’t really use anyway.

You can only clarify this in the store, so it's best to go there again with a friend.

I don’t think they would cooperate, cause well it seems like it was done on purpose anyway. And i would for sure just be hit with “we can’t cancel it” in the face. Seems like a common thing in such cases.

There is no other option. Try this route first.

if you sign in a shop are can’t cancel contract. You can only cancel after 24 Month.

But you can cancel the contract from today so that you can’t forget after 24 Month.

After the 24 Month you can cancel the contract to the end of the next month, if you forget to cancel. If you don’t cancel the contract, your contract will extend for a month, until you cancel.

The only way is, if the shop makes a mistake.

Please go to the Verbraucherzentrale in your city, ask the to assist you to find a mistake of the shop.

Take all your papers it’s with U take has handover by the shop.

I'm sorry that you had a bad experience in one of our shops. The fact is that contracts concluded on site are valid immediately. As you have already been told, you would have to clarify these questions on site.

Of course you are free to send a complaint to our customer service. 

From your story, however, I read misunderstandings rather than a real mistake in the booking? Or are you currently missing promised discounts or benefits?
