Real Inkasso Bank Account blocked

Hello, Real Inkasso have blocked my bank account but I’ve sent them a really long time ago that I’ve paid my 29 euros bill to O2. Now they’re charging me the full amount price of my contract with O2 declaring that this is due their service fees. I am lost and desperate for help. 

Does anyone faced this problem? Any suggestions on how to proceed, who to contact?

I could take a look and see indeed a bill/contract for which we did not receive payments and gave the outstanding payment demands to Real Inkasso.

Yes, with this you can negotiate with Real Inkasso, as we no longer have insight.

Difficult situation. Actually, it can't be because of the €29 cell phone bill. According to the Telecommunications Act, a cell phone contract can only be blocked and subsequently terminated without notice if the bill exceeds €100. And only then does it go to debt collection. Is this perhaps about other, additional costs? Installment payments for cell phone purchases? Smartphone-Contract?

If it is only about the mobile phone contract, then 100% of the remaining amount is not enforceable. Courts are more likely to recognize 10-30% of the remaining amount until the end of the contract. Only the lost profit can be charged.

I don’t have absolutely anything pending of payment. They declared that as I was with one payment pending their client (O2) had the right to use their services and now I have to pay it. In German any case it could help understanding:

 

“Da Sie sich im Zahlungsverzug befinden, war unsere Auftraggeberin berechtigt, uns mit dem Forderungseinzug zu beauftragen. Die hier entstandenen Kosten haben Sie zu tragen.”


I’ve messaged Inkasso but I am not sure if this is the case of negotiating with them.

Is it just a mobile phone contract or an installment payment for a device?

You must have received several reminders from o2 or debt collection. Have you not been able to clarify this?

What amount is being demanded?

If your bank account has really been blocked then it has gone much further than just Inkasso letters because that would mean a court has placed a third party debt order on your account requiring your bank to transfer some of your balance to the creditor each month until the debt is paid. Did you perhaps receive a default summons (Mahnbescheid) from the court and not respond to it? In that case Real Inkasso may have obtained an enforcement order (Vollstreckungsbescheid). In any case you must have received several letters.

Concerning the costs, it is possible that not all of these have to be paid. Some Inkasso companies will try to recover costs they are not entitled to assuming the debtor is unaware of what is allowed and what not. The creditor (o2) also has a duty to mitigate losses. if the costs seem unreasonably high, it might be worth contacting the consumer protection agency for advice. The Inkasso company is unlikely to want to negotiate, but they will also probably not try to pursue costs they know they are not entitled to recover.
