Invoice to deactivated account

Hello,

 

My name is M. Haouachi

My contract was terminated early on my request because I moved out to another apartment with an ongoing internet connection.

I've already contacted Telefonica as well as o2 and sent the required proof. A ticket was opened for this by the number S-xxxx.

 I have been informed that my contract will be terminated at 15.04.2025 and that I will still have to pay without being given the choice if I agree to this or not. 

 

I called o2 and telefonica on 12.04.2025 to clarify this situation but I was assured that I will just pay for April and then I will not be charged for anything after.

 

On 21.05.2025 I received an email with an invoice of 399 euros which seemed to be the fees for the contract for the rest of the 10 months. I would like to have more transparency on this matter.

I would also like to understand why am I paying for a service I'm not receiving ? and why I have not been given the choice whether to keep my contract and pay for it. Because I would have never agreed to pay for a service I'm not receiving and I would have found another measure to deal with this.

 

Please note that I have only started this procedure based on the recommendation from an o2 agent in Alexanderpl. 3, 10178 Berlin Shop.

 

 The only reason I’m posting this here is because I didn’t receive any feedback since almost 2 months.

Well, I’m sorry to hear that you obviously got the wrong information about an early cancellation because of a move. 

A move is part of your personal life planning; a special termination notice will only be granted if we cannot provide DSL at the new address. As soon as the availability check shows that you can get DSL from us at the new address, we offer two options: First of all: you take the connection to your new address and "preserve” it there until the contract term is up. This requires another proper termination notice. Until then, you fill out a relocation application and continue paying the monthly basic fees as usual. It is not important for the move whether the telephone line in the apartment is occupied but rather whether there is a free space in the main distribution frame for the address. 2. You terminate without moving, in which case a timely termination notice will be entered. However, as soon as the new tenant registers their own connection and the socket is still occupied by you, things get tricky. We are obligated to vacate the socket and then terminate the contract. You will then be billed for the remaining amount without any installment payments. This can be expensive depending on the number of remaining months*basic fee.

So as your contract is already cancelled there is nothing left we can do for you. Waiving the invoice is impossible.

Moving to a new address does not automatically lead to the termination of a contract. If you move you have the option to take your contract with you. It is irrelevant for the contract whether there is already a connection at the new address. If o2 is unable to provide the same tariff at the new address you can terminate the contract with just one month's notice. If you do not apply to take the contract with you, o2 will deactivate the connection at the old address and charge for the remainder of the contract. It looks like this is what has happened. The only thing you can do now if you do not want to pay the full amount in one go is to request that o2 continues to bill you monthly for the rest of the contract term.

This is not what was communicated with me. Also I fulfilled the necessary requirements. Their reason for billing me is that “ I canceled too late”.

Which requirements? What steps did you take exactly? If you don't actively opt to move the contract to zmyiur new address, the provider is obliged to deactivate it. At that point it would be too late.
