Hello
i have read all previous postes regarding leaving germany and how to stop our contract with o2 but none is talking about whats happens when you dont have an abmeldung, i explain myself.
- i came in germany a month ago and stayed at a friends place.
- i made a 24 months o2 contract with only a phone line. The person who made me the contract did not ask me for anmeldung.
- i am now leaving Germany, i have sent to o2 my working contract in foreign country and rental contract for my future flat.
- i, obviously, cannot have an abmeldung since i did not register in Germany for my short stay here.
What can i do ? Is there any special exception for this kind of case ?
Thanks for reading

Hi there,
well to be honest this is a very strange situation you seem to be in. First of all, o2 also has Prepaid contracts as other mobile carriers have them as well. It is quite foolish of you to make a 24-month contract, stay for 1 month and then leave Germany again and not even formally register yourself at the German Citizens Registration Office. You should have been aware of that beforehand if you will stay longer or not. Maybe in the future you will make wiser decisions regarding phone plans.
However, I would still fill out this form: https://static2.o9.de/blob/12985654/v=3/Binary/contract-cancellation-moving-abroad-download.pdf and send it back to o2. Provide a certificate of your new foreign addresse as stated. Since you did have to provide a German address when you made the contract, just try to get a de-registration confirmation of your landlord or any other proof that you do not live at the German address anymore. Nevertheless, you will have to pay a all-inclusive basic fee of your monthly fee for 3 months. This way the mobile provider will get compensated in some way for letting you go earlier.
Maybe it works out for you. Wish you all the best!

Hey,
Thank you for your answer.
I understand the situation is uncommon. i would like to add that the agent who made me the contract did not ask me for an anmeldung. (This is why i would never have an abmeldung anyway)
I have sent to o2 the filled form and also my working contract and rental contract in Tunisia that starts on december 2017.

An o2 agent is not obliged to check your Anmeldung. You are legally obliged to go to the German Citizens Registration Office (Einwohnermeldeamt) within 2 weeks after you live at a German place. This applies to all citizens regardless of your nationality or status (also German citizens need to follow that). Germany is one of the few countries that have a compulsory registration. What you did is prohibted and I am quite surprised that you were able to get a visa in the first place and cheated your way around the system since I assume you are a Non-EU citizen.
Time will tell how o2 handles your case based on the fact that you did not register yourself lawfully.
Hope it works out for you
