Wrongly Charged to Cancel my Contract

Hello,

I tried to call the hotline but there is no English option, so hopefully posting on here will work.

I was studying for a semester in Germany and I took up a contract with O2. When I first signed the contract I was told I needed to go to the store and inform them a month before I needed to terminate the contract. From that date I set a reminder in my phone for a little over a month before I needed to leave to go to the store and cancel the contract.

A little over a month ago, when I was paying the bill for my last month of service I informed the employee that at the end of the next month I would have to terminate my contract. He told me to come back in two weeks to let them know and that two weeks time was enough notice to terminate the contract without penalty, so went back two weeks later and canceled the contract.

Now this morning I received an email from O2 saying that I need to pay 75 euros (the next three months of service fees) in order to cancel my contract. I did the right thing and I do not want to pay the fee because the employee of the store told me the wrong information and scammed me out of my money - I am really unhappy with this situation.

Early termination is not a legal right but a gesture of good will by o2. The form states that if o2 agrees to this, three months basic fee is charged. The employee you spoke to maybe didn't know this. You certainly haven't been scammed.

technically, your contract has a runtime of 24 months, so usually, it wouldn't end until March 2021.
In order to cancel your contract early due to moving abroad, you'll need to fill out this form as well as the papers mentioned in that pdf, which are as follows:

  • a de-registration certificate of your current (German) place of residence
  • a notification of your new, foreign domicile (alternatively a confirmation of your employer or landlord)
  • Your approval for us to charge you the all-inclusive basic fee for 3 months. The exact amount of the fee will be notified in a separate letter.
Just fill in and sign the form and send it back together with copies of the documents required via fax to +491805 571 766 or via mail to the following address:

In case your German bank account is no longer valid, keep an eye on your bills and pay them directly by bank transfer.
Also, please remember that the bills from your contract cover the preceding four weeks, so there will be a final bill after your contract has ended.
