Revocation of contracts

When a mobile phone contract is signed, the rules for revocation depend on how the contract was entered into. If a customer wishes to withdraw from a contract, it is therefore essential to know the sales channel

Revocation of contracts signed online or by phone

Customers have the legal right to withdraw from a mobile phone contract within 14 days without providing any reason, according to the Distance Selling Act (Fernabsatzgesetz, FernAbsG). This applies to contracts signed exclusively such as telephone or online.

The 14-day withdrawal period begins on the day the customer receives both:

  • your phone or SIM card and
  • the contract information whatever arrives last.

To exercise the right of withdrawal the customer must inform the mobile phone provider of their decision by means of a clear written declaration ( f.e. by letter or email). A withdrawal form (available in German) may be used but it is not mandatory.

Consequences of revocation

Once O₂ receives your cancellation you will get your money back within 14 days

This includes delivery costs (unless you chose a special delivery option)

O₂ may wait to process the refund until your device has been returned or you have shown proof that you sent it back.

Contracts concluded in an O2 shop

If you signed your contract in an O2 shop, the legal 14-day cancellation right does not apply.

This means:

  • You normally cannot cancel the contract once it is signed

  • In some cases, the shop may cancel it as a goodwill gesture, but this is not guaranteed

unfortunately it was more than 14 days ago cause i didn’t understand the pricing would be so high..until i got the bill. first time i got the bill i thought it was a mistake. i am mostly abroad in a zone 4 and only use my German phone when back in Germany. which is not very often. i used to pay 29 euros every month for more then 18 years- now suddenly 62 euros, first month i saw the bill ,  then i turned off all roaming off and again a high bill and now 84euros..
now i put the phone on flymode. this is crazy.
