Contract cancellation-no response


I applied for a contract cancellation for the mobile service in December when leaving Germany temporarily and i received a response that it should’ve been 14 days from the desired start date. I filled in another application and didn’t receive a response but now I have received countless emails with the invoice amount increasing every month even though I am still out of Germany. I have submitted a contact form but there is no response yet. Any suggestions on how to deal with this matter?

Leaving Germany temporarily is not a reason to terminate the contract early. If you didn't cancel it within 14 days, the contract will run until the end of the minimum term.

If you are only abroad for a limited time and then return to Germany, a suspension of the contract is possible with a proof (i.e.enrolement for studies abroad) is possible, if there still is an active banking account in Germany.

The cancellation, for which Bumer linked our article, is possible with a proof of moving abroad, i.e. a working contract for example.

Dear Gerrit, 

Thank you for your response. Yes I completely understand this.

This was the response the first time I applied for the contract: “Good day NGK ,Thank you for your order.Your documentation indicates that your contract was valid until December 19, 2025. Unfortunately, we are unable to determine what action we should take on your behalf in this matter. Please note that the contract suspension must be requested at least two weeks before the desired start date.”

After this I applied once again for the contract suspension but never got a response therefore I am still receiving invoices.

Hello ​@NGK,

the colleagues received a proof for the time of your stay, but as far as I could see not the form for cancellation of a mobile contract because of moving abroad.

You can go via our website for cancellations, then choose “Postpaid-/Festnetz-Vertrag”, fill in your data and your Kundennummer/customer number, which you find as reference on your bills:

and also add your current e-mail that we can send you a confirmations, choose like this and fill in the phone number of your contract:

Finally you can upload your deregistration of your place of stay in Germany and a proof that you are now registered, working or studying in a different country than Germany:

If you can still login to your Mein o2 customer account and see your bills, you will see the amount still open for your bills. You can transfer to us:

Dear Gerrit,

 

Thank you so much for your assistance! So if I understand well there is no record that I applied for the contract suspension? I made the first application for the suspension on the 19th of December dated until April 2026. I don’t want to cancel the contract entirely as I will be back in Germany soon so I just wanted the contract paused until my return.

A suspension is indeed different from a cancellation, ​@NGK.

Then the colleagues understood you first time, only they had no proof from you for the time you were abroad from Germany, like a certificate of enrollment for example. You send proof being in Germany until December 19th 2025.

The cancellation is then not needed, but a proof for a suspension to be made.

Also I advise you to transfer the outstanding amount from your bill, as otherwise there is a risk for your contract to be cancelled and the outstanding amount to be forwarded to a bedt collection agency.

Thank you for the information. So in this case as I’d still like the suspension to be made all I have to do is transfer the outstanding bill and upload proof of being abroad?

Hello @NGK. I’m sorry things turned out this way. Unfortunately, I don’t have any good news for you right now: It is possible to suspend the contract, but there is a minimum term of two months, and according to the information you provided, you’ll only be abroad until April 2026, so the period is too short. 

The most important thing now is that you settle all outstanding balances as soon as possible to avoid incurring further late fees.
