DOCSIS modulation is extremely low during evening hours

Since I started my contract (O2 home XL) I had issues with internet speed stability during evening hours. Download speed remains mostly high (around 300mbps) but upload speed drops to 2mbps, which makes the internet unusuable. I already opened a ticket but was closed because the technician that came did so during the morning, when the conection is fine. I tried contacting support through the hotline multiple times without success.

I also noticed that the DOCSIS channels are messed up because the modulation on docsis 3.0 drops to 8QAM when it should be 64QAM and docsis 3.1 is sitting at 32QAM when it should be 128QAM or 256QAM. So the problem is a lot of ingress noise, the huge amount of noise in the coax network.

The problem persists and since they are not willing to send a technician during the evening hours (when the problem occurs) I am seeking for a solution or I will be forced to end my contract with penalty according to TKG § 57 abs 4 (Sonderkündigungsrecht) attaching the Breitbandmessung report.

That is not so nice when your connection has such a low speed in the evenings.

When you write about a technician visit already happening, then a fault ticket has already been worked upon but closed after the visit, is that true?

I am sure the ticket was opened before the technician came. But when he did he measured the internet speed and said it was fine (since he came during the morning) and closed the ticket as if the issue was solved. I tried contacting the hotline afterwards with no success, last time the operator optimized my signal and said the problem was solved. But again, since I can only call until 6pm I am never able to call when the problem is happening, therefore they cannot see the problem. When the technician came I also showed him screenshots of the internet speed tests during the evening and screenshots of the docsis modulation during said time, however I don't know if it was the language barrier (screenshots were taken in german although) but he didn't seem to pay attention to them.
