I went into the 02 shop in Cologne ( Hohe Str. 65) around November to say that I wanted to cancel my contract, and I was told I had to do so before March 2018. I registered online to cancel my contract today (28th Feb), and when I called I was told the deadline to quit my contract was in December already, and that if I cancel the contract will run until March 2019. If I want to avoid paying up to 80 euros a month, as I currently am, my only option is to change my contract, which would then automatically extend to two years. I was offered that back in the shop in March - plus a tablet - but wanted to cancel.



When my first contract (24th March 2015, I believe) ran out, why wasn't I transferred to a rolling contract? Why was I transferred to a long-term contract without my approval?



Do I have any right to cancel my contract, since I was in effect lied to?



If no, can I change elements of my contract without extending it?

I am sorry that you got a wrong information about the notice period.



But in the end you also have all the information needed in your documents.



Your contract first startet at the 24th of March 2014, and the first runtime of 24 months ended at the 23rd of March 2016 then. You didn't cancel the contract, so it got extended automatically for 12 further month until the 23rd March 2017. You also didn't cancel it then, so it got extended automatically again for 12 more months until the 23rd March 2018.



As you see- the fixed times and periods of your contract never changed. And the information about the notice period for ending the contract (3 months before the normal runtime end) you can find in your documents, and also in your "Mein o2" portal online.

You didn't have to give another active confirmation, because it is written in your contract documents which you have approved. It was up to you to end the contract in time.

There is no proof that someone lied to you. In that case the shop staff is your contact.



You could have canceled your contract then until March 2019, but as I see you have now extended your contract actively for 2 more years. Is that now what you wanted?



There is no opportunity for us to cancel your contract, but at least you could have kept it as it was. The normal basic fee was 19,99€, you just paid more because of your usage.



Now the new contract is o2 Free S, are you fine with that?



The new start of the contract is the 14th of March 2018 and it runs until the 13th of March 2020. To cancel the contract until the runtime end you have to hand in the cancellation until the 13th of December 2019.
