Hello all, so may 23rd  I bought a new phone with O2 contract S20 samsung .I have been a customer with o2 since two years .I have wifi as well as mobile data services availed.Now i purchased this phone with o2 contract and since teh first day itself teh battery back shows problem within an hour or so the mobile dies even if I take all precautionary measures like data saver on brightness less and blue tooth off but no use the battery still dies out early.Its not even 14 days and I went to o2 shop and they asked me to visit samsung repair sop in templehof .But my question is why cant i return and get a new handy set why do i need to pay and keep afaulty set with me .I did pay 1000 euros for such a faulty set and o2 is not agreeing to return and exchange with a new phone .I am highly disappointed with o2 .I should be eligible for a free return since it falls within 14 days of period 

Where did you buy the phone? In a shop? If so, did you pay the full price immediately or are you paying in instalments? If you are paying in instalments then you have a right to revoke the contract within 14 days of receiving the phone. 


Hello ,Thanks for your quick respone.Yes i bought the mobile from O2 shop in potsdamer platz mall of berlin on 23rd may and bought it on installment.I went there for 3 times and they asked them to return the phone but they said they cant or they cant reissue a refund or cancel my contract .They asked me to repair my phone at samsung centre which was surprising .Could you please advice me how do i escalate the people as they are guiding me wrong and depriving me of my rights .They are not even revoking my contract which is really unusual

Is this one about a different phone/contract?

 

Either way: Purchasing a phone in a shop is different from odering it online.

If you buy the phone directly, full price upfront, there´ll be no Widerrufsrecht.

 

If you bought the phone with payments in installments and an attached mobile contract (new or as an extension to an existing one), you do have the right to withdraw from the contract within the first 14 days. However, you do need to do this in the shop where you bought the device, not in a different one.

 

That may be the reason, why the shop could not accept your device, but that´s just a guess.

What is the situation now? Have you managed to get it repaired or to get in touch with the shop?
