New contract when transferring to a new hoem

I have moved to a new apartment and wanted to bring my internet connection with me. I currently have 250mb/s plan where i’m supposed to pay 39,99 per month minus 5 euro from the kombi bonus and 5 euro as rabatt for 1 year, so i pay 29,99 monthly. I have called the o2 hotline and told them that i need to transfer my internet connection to a new address and said i would pay the 49,99 connection fee as i dont want a contract extension (i’m still in the 9th month of my 24 months contract). They had already set a date for the appointment. But someone called me today that unfortunately there is no space available for a 250mb/s connection and i will receive only 100mb/s. They sent me a new contract thru email which will extend my contract to another 24 months and i will pay the same monthly fee of 29,99 (34,99 minus 5 euro kombi bonus) but with 100 mb/s connection. What are my options on this matter? I wanted to clarify this to the one who called me but sadly i cant explain myself good in german. Thank you for your help.

You can cancel the contract with one month's notice, as the contractual service is not offered at your new address. See §60 of the Telecommunications Act

Thank you for your reply. What does it mean when there’s no open slot for 250mb/s at the moment? Will there be a possible slot in the future? Also will i be able to upgrade when a slot opens? Or can i cancel my current contract and apply for a new one. It says online that 250mb/s is available when i tried to apply. I want to stay with o2 if possible.

What does it mean when there’s no open slot for 250mb/s at the moment? 

This means that all available connection points at the desired usage address that could provide 250 Mbit/s are already occupied by other DSL customers and therefore cannot be used by you.

 Will there be a possible slot in the future? 

I am not a crystal ball and cannot predict if and when one of these DSL customers will move out or die.

Please note that in order to qualify for the new customer discount, you must not have had an o2 Home contract in the last 12 months. I would therefore not see any advantage in concluding a new contract compared to the contract extension already offered to you on the o2 Home M tariff.

it is unfortunate that we can't offer 250 mBit/s at your new address. This means that we cannot offer you more than 100mBit/s of the other connection types either.

As you have already said, you are currently in the ninth month of your discount, after which your connection would have been more expensive than the 100mBit/s we can offer you anyway.

However, the current price for the 100mBit/s is 39.99 and since you are currently only paying 29.99, you are already 10 euros below the actual valid condition.😊
