we got scammed by o2


Hello, 

 

ladies and gentlemen,

 

In the month of October, my husband received a call from o2 proposing a contract of a SIM card with unlimited internet for the cost of 19.99€/month. 
My husband at that time was in Stockholm for a week, and knowing that we were already thinking to buy one, his answer was to give him time until he comes back to Germany se we can decide together. the seller asked  when can he call again, so my husband gave him the date of the 12 of October, and as promised the o2 operator called on that date. I was not so sure about it especially that I had from the shop that is near us, a partner offer for 50% of discount etc.. we were sharing this with the online seller but he managed to convince us that we will not find the offer of unlimited internet for only 19.99€. 
And because we trusted o2 and we didn’t have any doubts that they will definitely offer us the best, we accepted the offer, the operator made with my husband an oral recorded agreement, by reading the contract and my husband agreeing by saying “Ja” to all what he was reading and so the contract was officially signed by voice. 
the seller told us that on Monday the 17th of October we will receive the SIM card , and that we will have the opportunity to test it for free for the rest of October, then if we want to cancel, it will be possible during the trial period.

On Monday nothing came, for a week nothing came, 2 weeks still nothing.. 3 weeks STILL NOTHING.., so until now that was the first disappointment and those were the two first promises that were broken :

1. to receive the SIM card on the promised date

2. to have 2 weeks of a free trial. 
So on the 4th week and exactly on the 3rd o November, my husband have called o2 asking where is the SIM card, (and I am almost sure that the person that we had on the phone is the same person who contracted us for the first card.) , he gave to the operator the Auftragsnummer, the guy took some minutes to find the contract and he was reading everything right etc.. then he said if you want I send the card again, but you need to sign the contract that I will send to you via email, at this point I was telling my husband but why do you have to sign when you have already made a voice contract before?? my husband have asked the seller why does he have to sign again, to be honest I don’t remember what did he answer exactly, but what I am aware of and what I remember very good is that he didn’t mention that this will be a new contract !!!! Anyways the operator have sent the contract via email, my husband have signed, really thinking that he is signing for the same first contract and not a new one.

some days later we have received a card, then the surprise came when another SIM card arrived !! So the card that we have received the first, was the card that is linked to the second contract that we didn’t ask for, and the one that we have received  later is the one that we have ordered and that was 5 or 6 weeks delayed …. and the biggest surprise was  that when my husband have checked his o2 app he found out that the contract  that we didn’t ask for  costs 44,49€ .. yes ladies and gentlemen 1067.76€ for the two years of contract that was made by pure SCAM .. so my husband decided just to go to the o2 shop having hope and faith that this mistake will be fixed (still thinking that is just a misunderstanding or a mistake) in the shop they told him that unfortunately it is not possible to cancel and that they will try by writing a letter.. and the answer arrived yesterday via post saying that the contract will not be canceled and that we have to pay for 24 months. 
 

Is it the best reward to give to a customer who is for more than 14 years by o2 ?? A scam ??

 

So, Dear o2, knowing that unauthorized charges and Financial Fraud is a punishable issue, and knowing that neither you or your operator had the permission to make us pay a second contract, and knowing that what we have fallen into is an absolute breach of the consumer rights, note that all these are serious issues…

so these are the steps that we are going to take against you if the termination of the contract will not be made:

 we will block any kind of debit from o2 in our bank. 

we will get in contact with the federal Ministry of Justice and consumer protection.
We will ask you by law to provide us with the audio recordings of our calls with your operators + their complete names.

we will hire a lawyer and we will sue the person who made my husband sign a second contract by scam, and we will sue you for breach of consumer rights and that’s as a consequence of your non favorable answer to our request to cancel a contract that we didn’t ask for, which makes your non-cooperation with us evidence of your involvement with the operator who defrauded us. 

Ps: we have already many screenshots of similar cases on your forum, of many victims like us and this strengthens our position.

 

we still welcome solutions that respond to our rights, and if we will not be treated fairly, the law will bring Justice to our favor.

please do not post your request in different posts. This only makes it more difficult for us to process your request. 
In your other post you have already received an answer from my colleague. There it continues, here we close the processing again.
