I got scammed by O2

Hi there,

I have signed a contract with O2 in August (both Mobilfunk and Kabel), but I mentioned that I will only use them on September. The agent told me that this is fine (his scam, but my mistake).

I started using my phone number this week, and it doesn't work, I literally have to tape it to a specific place in my window to get a humble bandwidth of data.

Why would I need data in my appartement when I have Kabel? Because O2 also failed to send me the router/box, so I also have no Kabel internet.

So now, I am stuck with no phone coverage and no internet, and their support is playing games.

Today they sent me a bill for a service that doesn't work. It so crazy.

I am already in contact with lawyers who are studying the situation, but it is less likely that they will help. I also spoke with the federal office of consumer protection. But I would like to know if someone went through this path before. How did you do it and what it is your advice ?

Cheers.

You signed a contract in a shop? You also ordered a router?

If you are paying a lawyer to look into this for you then they will tell you what is possible and what not.

What did the consumer protection agency advise you to do?

None of them have replied yet.

I am basically trying every possible way, but in addition to canceling at least the phone contract (I have already bought a Telekom sim), I don't want O2 to charge for a service that they can't provide. This week was pretty damaging to my work and my personal life and next week will most likely be too, and I want them to answer to that.

I made your answer as solution, do you know how can I remove that ?

It's not that simple. Poor reception in a particular location is not a reason to cancel a contract as mobile contracts are not tied to a particular place. Did you check the coverage before you signed the contract!?

If you ordered a router then of course o2 should send it to you. If not, then you will need to buy one.

I see, but it's not any area, it's my house and neighborhood, imagine I fall on my head on the shower and I need to call ambulance and there is no service.

I know a judge would rule in my favour in the light of a scenario like this. I just don't know how to bring it to a judge.

In an emergency you can call 112 as long as your phone has a SIM card in it and receives a signal from any provider.

No mobile provider has 100% coverage and no mobile contract guarantees reception everywhere or in a particular location, so this is not an argument. A judge would know that. Again, it is not that simple.

I only have one provider, and I have zero coverage in the house, my phone is not even connected to the antenna inside my house.

Besides that I live 5 min from Stuttgart the capital of BW. I don't live on a mountain.

You have zero coverage from any network? In an emergency your phone will use any available network.

Where you live is irrelevant.

I have coverage from voda, and telecom. But not from O2. But I have a contract now with o2.

Yes, so in an emergency your phone would connect to Vodafone or Telekom to enable you to make an emergency call.

I assume you have checked that there is no temporary fault with a base station in your area? What is the postcode?

70372, I don't think so. I jad to ask everyone who had been in my appartement whether they have O2 and how it does work. And they confirmed a similar experience as mine.

Perhaps you should have done that before you signed the contract?

it wasn’t necessary to do it, as I have the 14 days of trial, but one of your colleagues told (scammed) me that what matters is the activation day.

I actually made sure not to activate the sim card, only when I need it to have enough time to try it, but it did not work.

I spend my whole day at home, with zero service.

Dear @m.yassine ,

welcome to our community. 💨

I am sorry to hear, that you have problems with your mobile data. Have you already taken a look at the Live-Check to see what your current network availability is like? Were you able to report a fault or is something already known there?

At a new contract a SIM-card is automatically activated after three weeks. From this moment on you have to pay for that contract. You have a 14 day right of withdrawal. After that, you can only terminate the contract at the end of the 24-month term, unless you are granted a special right of termination. The registered cancellation for September 14th 2022 was cancelled again on the hotline today. Is that how you ordered it?

Thanks to @bs0 for the support.

I have removed the marking of the correct answer for you.

Kind regards,

Andrea
