I made a contract in May 2015 with O2 to purchase a new phone and a new data contract. I was also given a free bonus sim card which I did not want, need or ask for. The sales guy said it was free so why not. I have never even taken the sim card out of it’s packet and have no use for it. After 2 years O2 started charging me €19.99 per month for this card despite knowing I was never using it! They never told me I had to cancel it with 3 months notice because the guy in the shop said it will be cancelled automatically if I never used it! I never wanted it in the first place and still have no use of it. I only was aware of it when i logged in to the O2 online website to see I now had 2 mobile numbers!

What kind of a company behaves in this manner? I am now being forced to pay €69.98 per month for something that should cost less than €35. Also, Upon automatically renewing the contract for the sim I was using in my phone, they also put the cost up from €39.98 to €49.99 per month!! For only 25gb! So now I pay €69.98 per month for 25gb. How can a company be so unethical?

I have been treated with total dishonesty and lies from O2 and they insist I must keep paying €19.99 per month for a sim card I have never used. Is this not criminal extortion? They clearly see I have never used it but because their sales guy mis-sold to me, they take zero responsibility for their employees corrupt sales tactics. This behaviour needs to be public and O2 need to be accountable for mis selling.

Hi @Coolest

welcome to our English community.

I regret that there was obviously a misunderstanding about the contract with the tariff “o2 Free S Kombi”. This tariff has a basic fee of 14,99 € per month.

I just checked your data: As you signed for this contract in the shop, you do not have an extraordinary cancellation possibility. Please try to clarify this issue in the shop where you signed the contract. But I guess that you will not have a great chance to cancel this contract as 2 years have already passed now.

Did you not see this contract each month on your bill?

I understand that you are not happy about this information, but in this case, I do not have a solution for you.

Concerning your contract with the tariff “o2 Free XL”, I noticed that the discount of 20 € has been deactivated after 24 months on 16th May 2020. If you agree to an extension for further 24 months, we can check if we can offer you again a nice discount.

If you are interested in an offer for extension, just let me know how much data-volume you need and if you would like to get also a new device.

You can also check your possibilities for extension online under the topic extension possibilities (Vertragsverlängerung) .

We look forward to your reply.

Loving greetings,

Tobias

Dear Tobias,

Thank you for your reply.

I didn’t see this extra contract on my monthly debit because it didn’t come through separately on my bank account. It came through as a single transaction, the two were added together. So it wasn’t so obvious. I was working abroad in the far east and didn’t have the ability to go online to check and certainly cannot do internet banking from there. I made the mistake of trusting people in O2 believing that they were honest and would not be tricking me into something I never needed. Only to find out 2 years later how unscrupulous they really were to me.

Why should I have to go into the same shop where I made the contract? I called the shop in Paderborn but the woman made out the guy doesn't work there anymore so they cannot help me. I don’t live in Germany now so calling into the shop isn't an option. The contract is with O2, not the shop or the person that made the contract. If I have a problem with my Honda motorcycle I can take it to any Honda dealership, I don’t have to return to the dealer I bought it from. The problem is with the product, not the store. In this case it is a problem with my contract with O2. O2 make it very easy to extend, renew, increase or get a new contract or new handset. I can do it all online in a few seconds. But they make it extremely difficult to cancel. I went into an O2 shop with a hand written letter to cancel both contracts, the letter was faxed, it was also posted in the mail, I also made the cancelation online, even after all these attempts by me to end the contracts they still text me saying I must phone them within 10 days to confirm the cancellation. But they conveniently never included the phone number I needed to call. They put every obstacle in the way to make a cancelation but I can sign up for more years in 2 clicks online.

I left Germany in September 2019 but let the contract run because I still was using the phone. I only found out later they made me new contracts that I didn't want or need. Due to this dishonesty and obstructions, I don’t wish to extend with O2 and would like to cancel both as soon as possible. I was told by a lawyer I am permitted to cancel within a month if I leave the country. I have my proof from the Rathaus when I left in September 2019. Can I send it to you privately and get these contracts cancelled as soon as possible?

Kindest Regards

James Mcfarland

Dear @Coolest ,

every month you’ll receive an invoice from us and on this invoice both contracts are listed with their discounts. A look at it over the last years would have shown you that you have two contracts. On these invoices the duration of the discounts is also listed, if the discounts have a certain duration. The discount for the o2 Free XL expired in May 2020. This was also shown to you on every invoice.
The cost of the o2 Free S Kombi has not changed in all this time, it always cost 19.99 Euro - 5 Euro combination benefit.

You also received an infomail from us on May 15th 2018 to your emailaddress, where the new contract with its conditions was confirmed to you.

As my colleague @o2_Tobias already said, you signed the contract in the store and only the store can help you there. However, I also doubt that the shop will do this after more than two years.

If you have moved to another country, you can fill out the following form ( Contractcancellation moving abroad ) and send it to us either by fax or letter. We do not offer email support.
The completed form must also be accompanied by the additional documents specified. Please mind to cancel both contracts! You will then be informed about the remaining amount to be paid. Afterwards the contract(s) will be deactivated.

Kind regards,

Andrea
