The maximum speed technically available at your connection address is shown in the o2 availability check before the order and is mentioned in the o2 order confirmation. What does it say there? Which tariff did you choose?
This was never given to me as I took the connection from the shop, The employee said my house will get a speed of 50mpbs. So I choose the speed medium. This availability check shows a maximum of 16mpbs at my address. This is clearly cheating. The O2 employee did not disclose this information and I was thinking that I will be getting a 50MPBS speed. Please cancel the contract as I do not want anything to do with O2.
There is no legal right of withdrawal for contracts concluded in a shop. Please contact the shop to discuss any revocation as a gesture of goodwill.
Otherwise the contract can only be cancelled at the end of the agreed term.
If you have chosen a contract without a minimum contract period ("Flex contract"), the cancellation period is 4 weeks to the end of the month.
If you have decided for a 2-year contract, it can only be terminated with a notice period of 3 months to the end of the term.
If you want to cancel or revoke the contract, please note that other DSL providers using Deutsche Telekom's DSL wholesale services cannot offer you better speed until the VDSL vectoring upgrade is completed.

s92 indicates that your connection is an ADSL2+ connection. This is consistent with the result of the availability check. It is therefore unlikely that there is a technical problem with your connection.
In the German Civil Code, the German legislator grants a right of withdrawal only for contracts concluded outside of business premises, e.g. for telephone or online orders. Since you have concluded the contract in a shop, this is not the case and §356 BGB does not apply. So there is no “trial period”.
The scope of services of the tariff you have chosen should also have been made known to you in the shop. If this was not the case, you must clarify this with the shop employee. The shop in which you have concluded the contract can also annul the contract if there has been misconduct on the part of the shop.
On the part of o2, 10 Mbit/s also correspond to the contractually agreed scope of services. See product information sheet.
For customers who want to remain flexible, o2 offers all DSL tariffs even without a minimum contract term. As already mentioned, you can terminate such a contract at any time with a short notice of 4 weeks to the end of the month. If, on the other hand, you have concluded a 2-year contract, you must fulfil the contract.
Next lower contract would be dsl S. but only 10 Mbit Download and a hard cap of 100 GB.
so, M is mostly the best choice, even with 16mbit.

welcome to our community. I regret you did not get the full information in the store. But the assistant was right telling you there is a maximum speed of 16 Mbit/s available. I checked the website of German Telekom for further information because sometimes our database in not up to date in this case and the line owner already extended the service. But unfortunatey even Telekom doesn’t offer more than 16 Mbit/s at this place. So there is nothing to improve right now. Contracts signed in a store can’t be cancelled within 14 days notice. @Denner and @blablup were right in this case explaining the right of withdrawal.
So please be a little patient. We experienced it won’t take long until VDSL is available.
