If you want to cancel your 2-year contract prematurely, you have to provide:

  • die Abmeldebestätigung Ihres bisherigen Wohnortes
  • die Anmeldebescheinigung Ihres neuen Wohnsitzes im Ausland
  • alternativ zur Anmeldebescheinigung eine Bestätigung durch Ihren Arbeitgeber oder Vermieter (z. B. Arbeitsvertrag, Mietvertrag)
Then you can cancel the contract with a period of 3 months

My contract was activated in february 2015, so it is not the case you mentioned of cancelling a 2 year contract prematurely, at all!

My understanding is now that O2 will keep debiting my current account for three months in spite of me not leaving anymore in germany... is that correct?

Contracts with a minimum term of 24 months are extended by a further 12 months after expiry of the minimum term, provided that they are not terminated with a period of 3 months at the end of the minimum term or at the end of a respective renewal period.

Which means that your contract can not be terminated normally until February 2018.

According to the Telecommunications Act you are allowed to cancel the contract with a period of 3 months when you move to a location where no service can be provided. Therefore, you must prove that you are actually moved abroad.

Dear sir or madame,

I do not want to pay almost 40 euro per month until February 2018 ( ! ), because I left Germany on last June 30th and was back to Italy since then. This is unacceptable and unbelievable!

Should I send you my Italian certificate of residence? (I have already sent you by "abmeldung", however...).

Furthermore, can you please confirm me that you have received my termination request?

Thanks

It seems you did not read or did not understand my first answer.

In order to cancel your contract to an earlier date, we require copies of the following
documents:
- a deregistration certificate of your present place of residence
- a notification of your new, foreign domicile alternatively a confirmation of your employer or landlord

You have to prove with these documents that you are actually moved abroad . Otherwise the contract has to be fulfilled up to the regular end of the contract. It's up to you to provide the necessary documents or not.

Dear sir or madame,

I have just sent - for the third time - by fax (fax number 01805571766) a request for the immediate termination of my contract together with my "abmeldung" (deregistration from Germany) together with an official certificate issued by the Italian Authority certifying that I am now resident in Italy.

Kind regards,
