Leaving Germany. Need to cancel phone contract


I'm a student in Germany and I will be leaving in April so I would like to cancel my contract. Reading other forum posts I noticed that you need to cancel per post with

  1. a filled out cancellation form
  2. date you want the contract to end
  3. de-registration form from the German city you currently live in
  4. either a work contract from the other country or a rent contract.
My questions are: what happens if you don't have an employment contract or rent contract yet? What other option is there? For example as a student  what if you return to live with your family while you find a job. A one way flight ticket is proof enough?

If I start this process now but will be leaving in 4 months do I need to go de-register from the city now? I'm not sure you are allowed to de-register this early.

Only a one way flight ticket is not accepted as a proof. In that case you need a confirmation of your parents that you are moving back to their place. With the details of them and their address, as well as mentioning the date when you move in and all, explaining that you do not have a new employment contract or a rent contract yet.

Here you can also attach the one way flight ticket then.

No, the de-registration form of the city you get earliest 1 week before you leave I guess (just reconfirm this by asking the people from the office straight). Until then just hand in all the other information. When you have the de-registration form send it to the company as soon as you have it, and the process will start and get completed. ☺️

I understand that when canceling because of moving abroad, and if we have a 24 month contract with automatic extensions, we need to pay an additional 3 months of the "all-inclusive basic fee". How much is this basic fee? And does that mean we are entitled to continue using our mobile phone services during this 3 month period after leaving Germany?

I will try to explain you everything, if you do not understand something just ask again!

You do not have registered with your phone number here, hence I can not check your basic fee. The basic fee is actually the regular price of your tariff that you have to pay every month. If you have some discounts, your basic fee is the price of your tariff minus the discounts that you got granted. So you can just check online in your Mein o2 profile about your tariff options, there you'll also find your normal basic fee per month.

Actually the 3 basic fees are kind of a replacement. You have signed a contract for 24 months and o2 is just cancelling the contract because of moving abroad as goodwill. For cancelling the contract before the actual contract runtime end o2 is asking for that charge of 3 monthly basic fees. But you do not have to use the contract afterwards. The contract will get deactivated and in your last invoice then the price will be charged on your invoice. ☺️

I don't have to, sure. But what if I want to use the o2de contract during those 3 months? For example, if I move to Spain or France or UK, I would need mobile phone service temporarily until I have a local phone contract in the new country.

That won't be possible because the contract will be deactivated. The 3 months basic fee is a "penalty" for early termination.

I am leaving Germany at the beginning of May and I visited my o2 shop to cancel my internet connection at the start of February. The shop filled out the correct form and I provided an email copy of the notice I gave to my landlord as proof of departure. The shop then forwarded this information to o2. Unfortunately o2 wrote back to me by mail to say that the evidence was not sufficient. Since then I visited the o2 shop again with a letter that shows that I have a job offer in another country and so have to leave. The shop faxed this to o2. However, I have not received any indication if this fax has been received or whether the cancellation is being processed. Can you advise please?

The letter informed you that we still need a deregistration certificate of your place of residence in Germany.

I remain a little confused. I can only get a certificate of deregistration when I am actually leaving Germany (i.e. on 8 May). In that case, I can send the abmeldung when I receive it on 8 May as well as the router and also close my German bank account and then the contract will be cancelled. Is that correct?

Yes, that´s true. Then we need to wait until May to get your deregistration note and your DSL-router.

Only after we received all documents from you, we can terminate your DSL-contract to an earlier date.

I have returned my router and submitted my abmeldung. However, I have received a bill from the period up to 27 May when my cancellation should kick in from 8 May. Can you confirm that my account is cancelled and I will be charged up to 8 May?

Hi Martin,

at the moment the contract will be regularly end on 28th of november 2019. After the receipt of the "Abmeldebescheinigung" your contract will be terminated in three month. That's why you got another bill.

i have sent my deregistration evidence and my router back as o2 requested and which I was informed would cancel my account. I had flagged the departure date three months in advance with o2. I have done what was requested.
Do you have any proof? If so, then please make screenshots and post them here after anonmyzing them. Perhaps this could help.
As everything is done by post and not online for some reason, all I have is the tracking report to say that my router has been received by o2.


As far as I have understood, the problem is not the router but the deregistration.
Sorry, my bad, I meant the "Meldebescheinigung". 😞

In order to cancel the contract my colleagues need a notification of your new, foreign domicile or alternatively a confirmation of your employer or landlord (Meldebescheinigung). This is the document we are missing.
