Can i get rid of one of the contracts?


Good morning! I’ve requested to change my promotion on my number but instead i had to pay for a new sim card. So i never received untill i went to a store yesterday and they gave me one. Now i dont need to have 2 phone numbers. Plus i’ve been charged for this promotion twice, without having the physical card with me. I was wondering since is ‘t a mistake that i actually made. I would like to get rid of one of the contracts. I had to renew the old one because i had no diffenrent possibility. But i cant honestrly pay 70€ every month for something i dont use!

You will need to speak to the shop which sold you the contracts. What do you mean by promotion? 

They told me is impossible to cancel the contract. Which i believe isnt true cos no one can force me to have it. Anyway it was an offer for a new option and i wanted to activate it on my current number and it was online. Somehow i had to pay for a new sim card to have that offer. Yesterday they gave me a new sim card which i told them “i just want to get rid of it, i dont need a new one” their answer was” you cant cancel any contract”. So i kinda got a bit upset, took my card and left. They told me to call the customer service but unfortunatelly they dont speak english.

Did you sign the contract in the shop? If yes, you've got to live with the contract for at least 2 years, but you can cancel it now on expiry of its 24-months term.

Why did you sign a contract you didn't want? You are right, nobody can force you to enter into a contract, but if you do do then of course you are bound by its terms for the duration.

The first contract i did sign and that’s ok. The second one was an online promotion where i never signed anything anywere and not even received the sim card for the last 2 months and i’ve got charged for it in the last 2 months. Which i find not correct at all. Since as i know, you can only activate the promotion with the physical card in your hands. So i’ve been paying for something i never had.

An online-contract has not to be signed. Its valid without signature.

What kind of promotion was it?

If the customer doesn't activate a sim, the sim will be activated automatically after 21 days.

All free M was the promotion. Im sorry i will understand if i had the sim card and i didnt activate it but i’ve never received it so which will be the loint to pay something i dont have?

When did you make the online offer (exact date)?
Did you receive emails from o2 afterwards? If so, it was certainly there that it is a new contract (recognizable by the new phone number).
A cancellation policy and the explanation of how you can send the withdrawal o2, is also included as an attachment in the mail.

I did it in the 19th of september. I did received emails after with written i would receive my new sim within the next 48h hours (didnt happen) and after that i only had emails on how to activate the new sim with few reminders. So since i didnt received it i really didnt think about i would have to pay the rates anyway. I did pay the card but i wanst expeting to be charged for the promotion. I was expecting to be a new number since it was a new sim card. Going back to the beginning im looking to get rid of if because i didnt received it and i was paying anyway for that. No other emails refering on how to cancel it.

You entered into a valid contract. That is not affected by the fact that that you didn't receive the SIM as you could have chased this up. Just assuming is always dangerous where contracts are concerned.

So no solution to close one of them? 

Or at least is possible to give it to someone else and change the name on the contract?

To Close? No, you are too late.

Give it someone else: Yes. If you find somebody who want to use the contract, you can transfer this to him/her.

This process is called "Vertragsinhaberwechsel". You can start this on Mein o2 -> Tarif & SIM-Karte -> Vertrag verwalten -> Vertragsinhaberwechsel

You have to pay 29,99€ once.

My advice is to call up customer services and tell them you were deceived into the contract. I say this because in my experience o2 sales are willing to deliberately lie to make a sale and I suspect something similar may have happened to you.

A similar thing happened to me and I got my money back. It was by phone, and the sales rep told me I could get a special offer for renewing the contract, a nice phone and a new contract deal for a reasonable price. I checked with him, that it was definitely a continuation of the contract with the same phone number, and not a second contract, and he confirmed this 100%.  A few days later I got a bill for around 700 euros and a new sim with a new phone number. And yes, a second contract. He totally lied to my face! I challenged it and got a refund and the second contract cancelled. I was pretty annoyed. I was told it was a „rogue employee who has since left“.

Well guess what, almost exactly the same thing It happened again the following renewal. I caught it before any money was charged, with very persistent questioning. I completely lost any good faith in o2 at this point. Just bare faced liars, despicable.

My contract is up for renewal again and I am only being offered the same contract or one more expensive. I actually want one with less data but it doesn’t seem to be possible. I also tried in a shop. Why not? The contracts are of course notoriously difficult to cancel with the unusual (compared to other industries) rule of 3 months of notice, so being forced to remain or upgrade seems a bit wrong to me. It’s also more expensive to renew than it is for new customers. Why do existing customers get such bad treatment?

please do not forget to cancel at least one of your contracts in time. The old one does not expire without your cancelation-letter. I'm truly sorry, but we can't do anything for you. I hope the advice from all the experts helped at least a little.

Was I not being nice? Hmmm, no offense was meant, my apologies. I was just telling it like it is. I’ve just had bad experiences with the call center, although the forum is much better.

So i will say i didn’t really find any solution because no i cant find anyone to get my contract. So is a way to get some deals? I would be interested

I'm really confused now - you want to get rid of one of the contracts, right?

Why would you want another deal - which is only possible, if you agree to another 2-year-term for your frist shop-made contract?

And the other one is iron-clad for the next (almost) 2 years - we don't have any wriggle room there. You agreed to the conditions you chose on our webside - so... that's it.

Sorry but i got confused aswell with the 2 mixed up conversations. Anyway then there is still a chance to cancel my old contract by sending a letter? I’ll try otherwise i’ll follow the faith!
